
Justice Efe Ikponmwonba of the Edo State High Court in Benin City, Edo State, convicted and sentenced three siblings, Emmanuel Udofa, ThankGod Udofa, and Jonathan Udofa, to jail on Thursday, November 25, 2021.
The trio was charged with one count of false representation by the EFCC’s Benin Zonal Command.
The Udofas falsely represented one James Changhan, a Chinese, in January 2021 with the intent to defraud, in violation of section 484 of the Criminal Code Cap 48 Laws of Bendel State of Nigeria (as applicable in Edo State) 1976.
“Emmanuel Udofa (Alias James Changhan.) sometime in January, 2019 at Benin City, Edo State within the jurisdiction of this Honourable Court did falsely represent yourself to be James Changhan (a Chinese man) and thereby committed an offence contrary to section 484 of the Criminal Code Cap 48 Laws of Bendel State of Nigeria (as applicable in Edo State) 1976,” according to the charge against Emmanuel.
When the charge was read to them, the defendants pleaded guilty.
The prosecution counsel, Ibrahim Mohammed, who stepped in for Francis Jirbo and I K Agwai, requested the court to convict and sentence the defendants in accordance with their pleas.
Emmanuel and Thank God were convicted and sentenced to three years in jail with a fine of two hundred thousand Naira, while Jonathan was sentenced to three years in prison with a fine of one hundred thousand Naira.
The Judge also ordered that a Lexus ES330 2004 car, N3, 545,704.24 (Three Million, Five Hundred and Forty-five Thousand, Seven Hundred and Four Naira, Twenty-four Kobo), iPhone 12 Pro max; iPhone X Pro max; iPhone 11 and one Samsung galaxy, all of which were recovered as proceeds of crime from the defendants, be forfeited to the Nigerian government.
