
A Federal Capital Territory High Court has ordered the Economic and Financial Crimes Commission (EFCC) to compensate Dr Monday Ubani, Chairman of the Nigerian Bar Association Section on Public Interest and Development Law, NBA-SPIDEL, N12 million for his wrongful arrest and incarceration for 20 days in 2019.
The EFCC arrested and imprisoned Ubani and Senator Christopher Enai on March 19, 2019, for failing to produce Ngozi Olejeme, the former Managing Director of the Nigeria Social Insurance Trust Fund, NSITF, for whom they both stood as sureties.
On Wednesday, January 26, Justice Sylvanus Oriji declared that Ubani’s arrest and subsequent 20-day incarceration was unconstitutional and a breach of his rights.
The judge ordered the EFCC to pay Ubani N12 million in damages after refusing to require the anti-graft agency to issue a public apology for the wrongful imprisonment.
